THE HIGH COST AND PENALTY OF DRIVING WITH A SUSPENDED LICENSE


Having your driver's license suspended can be devastating for many reasons. It can lead to pricey fines, incarceration, and, at the very least, a great deal of inconvenience, especially if you need to drive to get to your job.

Here are some of the serious repercussions of driving with a suspended license in New York State. As you can see they depend on various circumstances:

Aggravated Unlicensed Operation (AUO) of a motor vehicle in the Third Degree (AUO 3rd)—In most cases, the first time you are found driving with a suspended license you will be charged with AUO 3rd degree, a misdemeanor which has a fine of $200-$500 and/or a maximum 30 days in jail.

Aggravated Unlicensed Operation (AUO) of a motor vehicle in the Second Degree (AUO 2nd)—You can be charged with AUO 2nd degree if you are caught driving with a suspended license AND your license was originally suspended for driving while under the influence (DWI/DUI) or because you had several traffic convictions within the last 18 months. Depending on the situation, you may receive up to a $1000 fine and/or up to 180 days in jail.

Aggravated Unlicensed Operation (AUO) of a motor vehicle in the First Degree (AUO 1st)—If you're caught driving under the influence (DUI/DWI) while your license is suspended or you have a record of other offenses, you can be charged with AUO 1st degree, a Class E felony, which has a maximum fine of $5000 and a maximum of 4 years in state prison.
